Party A has hired party B. Both parties agree to the following terms:
甲方僱聘乙方，甲、乙雙方基於誠信原則，同意
議定及共同遵守條款如下：
1. This addendum is considered a binding part of the employment contract between
the two parties.
本附件備忘錄視為雙方工作僱聘合約的一部份。
2. Both parties agree that Party B has entered into an employment contract
with party A by free will. Both parties agree that during the contract at any
time and for any reason party B is allowed to choose to terminate the contract
by informing Party A in writing 14 days in advance.
甲乙雙方同意，乙方基於自由意願受僱於甲方並
簽訂工作僱聘合約，且遵守合約內容，同時，乙
方基於自由意願，不須任何條件限制，亦可自由
提出離職申請，但乙方必須於申請離職生效日
（期限）十四天前，以書面正式提出該項申請。
3. Both parties agree should party A choose to terminate party B, party A
must inform party B in writing at the time of termination. Party A agrees
that this written Notice of Termination will be an original, not a copy and will
be written in Chinese with an accurate English translation. This letter of
termination will bear all the official stamps of party A and that it will bear
the same date as the day it is given to party B.
甲乙雙方同意，甲方解聘乙方時，甲方必須於甲
乙雙方工作僱聘關係終止日期當天，開具內含
中、英文翻譯對照之正式解聘書正本通知乙方
（以下簡稱「解聘書正本」），該份正式解聘書不
得為複印本，且該份正式解聘書正本裡，除須蓋
上甲方具法律效力之印璽，亦須註明甲乙雙方工
作僱聘關係終止日期（即甲方通知乙方解聘之當
日日期）。
4. Both parties agree that Article 3's Notice of Termination will be delivered to party B
personally; that Article 3's notice of termination will not be given to any third party.
甲乙雙方同意，第3條之解聘書正本，甲方通知
乙方之方式，應為直接交予乙方本人，且不得給
任何第三者轉交乙方，亦不得以任何郵遞方式給
予乙方。
5. Both parties agree that Article 3's Notice of Termination will contain
only a statement of the employment status of party B and that editorial
comments or opinions about party B will not be a part of Article 3's Notice
of Termination. Further, both parties agree that party A will not approach
government offices with false, malicious or slanderous statements about Party B.
甲乙雙方同意，第3條之解聘書正本，其內容只
得為甲乙雙方工作僱聘關係結束之解聘聲明，不
得加諸任何評語。甲乙雙方同意，甲方不得向主
管機關為不實或不利於乙方之陳述。
6. Both parties agree that 2 (two) days after party B's employment with party A
is terminated, party A will write a suitable Letter of Release for party B. This letter
of release will be an original, not a copy and will be written in Chinese with an accurate
English translation. This letter of release will bear all the official stamps of party A and
it will bear the date of party B's termination.
甲乙雙方同意，甲方僱聘乙方期間內，乙方離職
或乙方被甲方解聘，自乙方離職或解聘生效日起
貳個工作日內，甲方須開具甲、乙方雙方終止工
作僱聘合約關係之內含中、英文翻譯對照正式離
職證明書正本（以下簡稱「離職證明書正本」），
該份正式離職證明書不得為複印本，且該份正式
離職證明書正本裡，除須蓋上甲方具法律效力之
印璽，亦須註明甲乙雙方工作僱聘關係終止日
期。
7. Both parties agree that Article 6's Letter of Release will be left in a
secure area of the location where party B was employed, accessible
byanyone in an administrative capacity during all times of the location's
operation. Article 6's Letter of Release is not to be sealed in any kind of envelope.
Both parties agree that two days after party B's termination or any time thereafter,
party B is allowed to personally arrive at the location where party B was employed
to collect Article 6's Letter of Release. Party B's arrival need not be previously arranged.
甲乙雙方同意，第6條之離職證明書正本，須放
置於乙方任職於甲方之原工作處所，並由甲方妥
善保管，在甲方日常工作時間內，由甲方之相關
負責或職務代理人員處理，且該份離職證明書正
本不得彌封於信封內。自乙方離職或被解聘生效
日起貳個工作日後，甲方不得以任何理由或藉口
拒絕乙方赴甲方工作處所，取得第6條之離職證
明書正本，且乙方亦不須經由甲方安排，即可前
往取得第6條之離職證明書正本。
8. Both parties agree that under no circumstances may Article 6's Letter
of Release be delivered by post. Article 6's Letter of Release can only
be picked up by party B personally. Party A agrees that if the managing
director leaves the location's premises, he or she must designate another available
administrative person who can give party B Article 6's Letter of Release.
甲乙雙方同意，第6條之離職證明書正本，甲方
交付乙方之方式，必須由乙方親自前往甲方工作
處所取得，且甲方應由相關負責或職務代理人員
負責交付乙方，且不得給任何第三者轉交乙方，
亦不得以任何郵遞方式給予乙方。
9. Both parties agree that Article 6's Letter of Release will contain only a
statement of the employment status of B. Editorial coments or opinions about
party B arenot permitted part of Article 6's Letter of Release. Further, both
parties agree that party A will not approach government offices with false, malicious
or slanderous statements about Party B.
甲乙雙方同意，第6條之離職證明書正本，其內
容只得為甲乙雙方工作僱聘關係結束之聲明，不
得加諸任何評語。甲乙雙方同意，甲方不得向主
管機關為不實或不利於乙方之陳述。
10. Both parties agree that if Party A fails to comply with the terms of this
addendum Party A will be liable for civil damages to party B to be adjudicated
in the ____________ (City or County) court.
甲乙雙方同意，若甲方違反本附件備忘錄內容，
乙方得請求甲方負損害賠償責任，若雙方主張歧
異而需涉訟者，則以臺灣____________（City or
County）地方法院為第一審管轄法院。
